PLANNING COMMISSION MINUTES

 

Wednesday, November 10, 2004

 

            The Planning Commission of Chadds Ford Township met in the Township Hall on Wednesday, November 10, 2004.  In attendance were Chairman William Taylor, Vice-Chairman Maurice Todd, Fred Reiter, and Paul Vernon.  Absent:  Gordon Daniels.  Kevin Matson, of Kelly Engineers, was also in attendance.

 

CALL TO ORDER

            The meeting was called to order at 7:40 P.M.

 

PUBLIC COMMENT

            There was no public comment.

 

MINUTES

            The Planning Commission motioned and approved (Vernon/Reiter) the Minutes of the October 13, 2004 meeting.

 

HERRMANN SUBDIVISION (Longview Road)

            Representing Franz and Estella Herrmann, Thomas A. Schocklin of Vollmer Associates presented this plan dated 8/27/2004 for a two-lot subdivision at 27 Longview Road consisting of 2.5 acres in the R-2 Residential District.  Because the existing house would have to be torn down in order for these lots to conform, Mr. Schocklin was seeking the Planning Commission’s recommendation to proceed to the Zoning Hearing Board.  The items in Kelly Engineers’ November 3, 2004 review letter were discussed.  Maurice Todd stated that if this application is approved by the Zoning Hearing Board, he will be looking at the landscaping on this site for screening and privacy.

            The Planning Commission (Todd/Vernon) voted to recommend that this Applicant proceed to the Zoning Hearing Board.

 

STONE BROOK III SUBDIVISION

            Representing Paul McLaughlin, John Fellows of Vollmer Associates presented this 8-acre 3-lot subdivision at 29 Atwater Road.  Both new lots have been tested for on-site septic and approved by our SEO. Storm water management through seepage beds is being proposed to promote ground water recharge.  This plan conforms to R-1 zoning.  The items in Kelly Engineers’ November 2, 2004 review letter were discussed.  Several items will require clarification on the plan and others were oversights by our Engineer. 

            Many of the Atwater neighbors were present, one of whom asked for relocation of a well noted on the plan.  Mr. Fellows advised that this well has already been moved by approximately 90 feet to the other side of the lot.

STONE BROOK III SUBDIVISION (cont.)

Lana Sheer expressed concerns about the fate of existing conifers; the construction of very large homes and the additional population and traffic on Atwater Road.  Mr. Fellows stated that if the trees were not marked, they will not be removed.  Mr. McLaughlin agreed to mark the trees, 18 inches or larger, that are to be removed with survey ribbon.  Mr. McLaughlin agreed to add some plantings on the west side of Lot 1 to screen lights from the adjoining neighbor’s property.

Code Enforcement Officer, Richard Jensen explained that the proposed storm water management for this site is a significant improvement over what presently exists for homes on Atwater Road.  In addition, if there are concerns about their wells, there are no guarantees about the availability of well water; however, the Battlefield is looking into public water which may be available to residents.

Another resident questioned the location of the existing house on the plan.  Mr. Fellows commented that it was survey located and he will confirm its accuracy.

Chairman Taylor summarized that the developer has agreed to mark trees to be removed; prior to clearing, the undisturbed areas will be fenced to enable neighbors to monitor both the disturbed and undisturbed areas; construction vehicles should not be parked on Atwater Road; and landscape screening will be added on the west side of Lot 1.

The Planning Commission (Todd/Vernon) recommended approval of this plan contingent upon satisfaction of all outstanding items in Kelly Engineers November 2, 2004 review letter as well as developer’s compliance with all of the items summarized by Chairman Taylor.

 

WAWA LAND DEVELOPMENT (Route 202 and Dilworthtown Road)

            Representing Wawa, Joseph E. Brion, Esquire, presented this land development plan that received preliminary plan approval from the Board of Supervisors on September 5, 2001 pending resolution of sewer service to the site.  Wawa now has an agreement with Concord Township Sewer Authority to provide public sewer service. 

Robert D. Irons of Bohler Engineering led the discussion of items in Kelly Engineers’ November 10, 2004 review letter.  The Zoning Hearing Board granted a sign height variance for 18 feet, but this must be correctly reflected on the plan.  Prior to the next Board of Supervisors’ meeting, these plans will be revised and submitted to Kelly Engineers for review, along with a letter addressing all outstanding items.

            The Planning Commission (Todd/Vernon) recommend approval of this final plan pending resolution of outstanding items in Kelly Engineers’ November 10, 2004 review letter, including Mr. Brion providing all documentation regarding waste water treatment.

 

HOFFMAN SUBDIVISION (Bullock Road)

            James Fritch, Regester Associates, representing Bryan E. Hoffman, presented this 6.526 acre plan for a 2-lot subdivision at 32 Bullock Road with an existing house, driveway, pond and stream.  A single-family house is proposed for the rear of this property.  Revised plans provide access off Carriage Path by tying into the existing 20 foot access easement.  Easement documentation will be provided Mr. Hoffman’s attorney, Michael J. Lyons, Esquire.

HOFFMAN SUBDIVISION (Bullock Road) (cont.)

 

Mr. Fritch read a letter from Michael J. Lyons, Esquire, stating that Mr. Robert T. Hobbs has no objection to this proposed subdivision.

            The Planning Commission (Reiter/Vernon) voted to recommend that the Board of Supervisors approve this preliminary/final subdivision plan contingent upon resolution of the outstanding items in Kelly Engineers’ November 9, 2004 review letter. 

           

 

 

At 9:50 P.M. Chairman Taylor announced that this meeting will be continued on Tuesday, November 30, 2004, at 7:30 P.M.  Agenda items for the continuance will be:

 

§         Chadds Ford Business Campus Lots 10, 11 and 12

§         Toll Brothers – Camp Sunset Hill

§         Route 1 Historic Overlay – Thomas Comitta

 

Mr. Taylor also announced that because of the Thanksgiving Holiday, the Planning

Commission Workshop will be held on Wednesday, November 17, 2004.
